NO PURCHASE NECESSARY TO ENTER OR WIN; A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Armstrong Garden Centers’ Hawaiian Days Sweepstakes:

How to Enter: Between June 28, 2012 and July 10, 2012, visit any of the 31 Armstrong Garden Centers locations and fill out an entry card and place it in the designated entry box at the sweepstakes display.

Winner Selection: After July 10, 2012, all entries will be collected from the 31 Armstrong Garden Centers location and consolidated.  The winning entries will be randomly selected and the potential winners will be notified no later than 5pm PDT, July 31, 2012 by email or phone if no email is provided. If Armstrong Garden Centers is unable contact the potentials winners within five (5) days of selection a new potential winner(s) will selected to replace the one(s) that could not be contacted.  Odds of winning are dependent upon the number of eligible entries received.

Prizes and Approximate Retail Values: One (1) grand prize winner will receive a a six (6) days / five (5) night trip for winner and three (3) companions to Honolulu, HI, on Sponsor-selected dates during 2013 (“Trip”).  Two (2) First prize winners will receive a $500 Armstrong Garden Centers gift card.  The Trip will consist of the following elements: (A) hotel accommodations at Aulani, a Disney Resort and Spa in Ko Olina Hawai'i (one standard room/quad occupancy, including room tax) for five (5) nights; (B) Up to four (4) round-trip coach air transportation on a Sponsor-selected carrier between a Sponsor selected major metropolitan airport near winner’s residence (“airport of origin”) and Honolulu International Airport; (C) Up to four (4) round-trip ground transfers from Honolulu International Airport to Aulani, a Disney Resort and Spa (the “Resort”); and (D) a $500 credit for use at the Resort only, expiring at the end of the stay.  Grand prize winner must decide on timing of Trip within three (3) months of drawing date.  All expenses not specifically mentioned herein are not included and are solely the winner’s responsibility, including but not limited to, food/beverages, round-trip transportation between the winner's residence and the airport of origin; travel insurance; laundry service; spa treatments; alcoholic beverages; telephone calls; merchandise; souvenirs; incidental expenses, parking and tips and gratuities. Travel and lodging are subject to availability, certain restrictions, blackout dates and Sponsor’s approval. Airline carrier and hotel regulations and conditions apply. If one or more of the grand prize winner’s companion is a minor, the winner must be such companion's parent or legal guardian.  Each winner and his or her companions must travel together on the same itinerary and possess all required travel documents, including a valid photo ID.  Winner must take Trip on Sponsor-selected dates January 2, 2013 – August 30, 2013, or Trip will be forfeited in its entirety. Approximate retail value (“ARV”): $5,475, which will vary depending upon point of departure and seasonal fluctuation of hotel rates and airfares.  If the actual value of a prize is less than the stated ARV, the difference will not be awarded. Any depiction of a prize is for illustrative purposes only. Prize is not redeemable for cash or transferable, except it is transferable to a surviving spouse residing in the same household. No substitution allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted. Sponsor will not replace any lost, mutilated or stolen tickets, travel vouchers, certificates or prizes. Prize elements may not be separated. Airline tickets issued in conjunction with the prize are not eligible for frequent flyer miles, and no code share flights may be used. Prize cannot be used in conjunction with any other promotion or offer.  The prize winners shall be solely responsible for any applicable federal, state, provincial, local taxes and/or local laws and regulations, and the reporting consequences thereof, and for any other fees or costs associated with the prizes.

2. ENTRIES: Limit one (1) entry per person and per e-mail address or phone number for contest.  Entries become the property of the Sponsor and will not be acknowledged or returned. No mechanically reproduced entries permitted. Proof of submission does not constitute proof of receipt. If there is a dispute as to the identity of an entrant, prize winner will need to provide valid government identification.

3. ELIGIBILITY: Open to legal residents of the state of California ages 18 or over.  Winner must reside within 20 miles of an Armstrong Garden Centers location. Employees of Disney Enterprises, Inc. or its affiliates, Armstrong Garden Centers, Inc. or its affiliates, and subsidiaries, supplier-partners or vendors, and prize suppliers (and members of their immediate family and/or those living in the same of household of each such employee) are not eligible.

4. CONDITIONS: By entering this Sweepstakes and/or accepting any prize you may win, you agree, represent and warrant that: (A) you will be bound by these Rules and the Sponsor’s decisions, which shall be final in all respects; (B) you release and hold harmless Disney Enterprises, Inc., Armstrong Garden Centers, Inc. each of their affiliated entities and the respective officers,  directors,  shareholders,  employees, agents and representatives of each of them (“Releasees”) from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury,  resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Sweepstakes or any Sweepstakes-related activity or travel; (C) the Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Sweepstakes or the prizes; (D) winner’s acceptance of a prize constitutes the grant to Sponsor, Disney Enterprises, Inc. and their assigns of an unconditional right to use winner's name, address (city and state or province only), voice, likeness, photograph, biographical and prize information, statements about the promotion and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; (E) in the event Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security or fairness of the Sweepstakes so that it cannot be conducted as originally planned, then except where prohibited by law, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; and in the event the Trip has already commenced, to terminate the Trip and return the Group to any airport of origin as soon as reasonably possible; (F) the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; (G) any portion of any prize not accepted or used by any winner will be forfeited; (H) the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; and (I) the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following:   (1) tampering or attempting to tamper with the Entry process or the operation of the Sweepstakes; (2) violating the Rules;  (3) violating the terms of service, privacy policy or other terms, conditions of use and/or general rules or guidelines of any Sweepstakes property or service; (4) acting in bad faith, unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (5) for any other good cause as determined solely by the Sponsor.

5. DISPUTES/CHOICE OF LAW: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; (3) no punitive, incidental, special, consequential, or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"); and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California State law, without reference to California's choice of law rules, governs the Promotion and all aspects related thereto.
